Crush Terms of Use

Welcome to use Crush Video Series membership service!

To use the Crush Video Series membership service (referred to as "this service"), please carefully read, understand, and comply with the "Crush Terms of Use".

This Agreement is jointly concluded by you and Shanghai Zhuama Network Technology Co., Ltd. and has contractual effect. Crush reminds you to focus on and carefully read the terms of this Agreement that are bolded, underlined, colored or otherwise reasonably prompted to your attention . Such terms may have a material interest in your rights and interests, including but not limited to terms that stipulate Crush's responsibilities, terms that stipulate the rights and obligations of both parties, terms that stipulate dispute resolution methods and jurisdiction, etc. If you believe that these terms may cause you to suffer some or all of your interests or rights in specific circumstances, please read the above terms again before confirming your agreement to this agreement or using this service, and use this service on the premise that you voluntarily accept these terms.

If you choose Crush Video Series membership services, you can indicate that you have read, understood, and agreed to sign this agreement by accepting the form of this service (including but not limited to clicking agree, accepting or next, entering the purchase process, making any purchase of Crush video content, participating in activities to obtain Crush video content viewing qualifications, conducting or participating in any transactions or activities related to this service, adopting any other form of confirmation operation, etc.), indicating that you have reached an agreement relationship with Crush, and voluntarily accepting and complying with all the provisions of this agreement.

If you are under 18 years old, you should read and confirm the terms of this agreement under the guidance and accompaniment of your legal guardian. If you are the legal guardian of Juvenile, we hope you can reasonably set Juvenile entertainment time and cultivate Juvenile healthy viewing habits.

1.Ordering Rules

1.1.

After successful recharge, the Crush account becomes the corresponding "Crush Member Account" within the valid period of the membership, and enjoys the membership rights of free viewing of the entire station's episodes during the valid period of the membership. You need to provide us with one or more payment methods. "Payment Method" refers to the current valid and acceptable payment method (including payment through third-party accounts), and the payment method may be updated from time to time. Unless you cancel your membership before the billing date, you authorize us to charge your payment method the subscription fee for the next billing period (please refer to the "Cancellation" section below).

After a successful Gem top-up and verification, the relevant products will be credited to your Crush account. You can then use the Gems to unlock our premium series for viewing. You will need to provide us with one or more payment methods. "Payment Method" means the currently valid and accepted payment method (including payment through a third-party account), which may be updated from time to time.

1.3.

Tourist mode, you further understand and agree that you will not use Crush account to log in, you will use Crush in tourist mode, you can also experience video, you can recharge or consume in tourist mode. And once you replace your mobile phone device or the end point device is damaged, all your user data in the tourist mode may be lost, if any loss is caused to you, you need to bear it yourself.

1.4.

We may offer various subscription packages with diverse membership categories. The membership benefits of different categories will not differ, but the effective time will vary. At the same time, we will not ask you for any privacy data because of membership.

1.5.

Automatic renewal. If you activate this automatic renewal service through Apple ID or Google Pay, and do not actively cancel this automatic renewal service during the subscription period, Apple and Google will automatically deduct the service fee for the next subscription period from the balance of the account bound to you when you activate this automatic renewal service (hereinafter referred to as the "Account") 24 hours before the expiration of each subscription period, thereby extending the membership valid period corresponding to the subscription period.

1.6.

Cancel renewal：Open "Crush App" -- > Click "Personal Center" -- > Click "Membership Services" -- > Click "Renewal Management and Activation Records" -- > Find the "Crush Membership" automatic renewal service you have activated on the automatic renewal page, and click to close it.

2.Password and Account Access.

You are responsible for any activity in your Crush account. By allowing other people to access your account (including access to information about your account viewing activity), you agree that those people will act on your behalf and that you are responsible for any changes they may make to your account, including but not limited to changes to your subscription plan. To maintain control of your account and prevent any unauthorized users from accessing it, you should maintain control of the devices you use to access the Services and not disclose your account password or payment method details to anyone. You agree to provide and maintain accurate information related to your account, including a valid email address, so that we can send you notifications related to your account. We may terminate or freeze your account to protect you, Crush or Crush Partners from identity theft or other fraudulent activity.

3.Warranties and Limitations of Liability.

The film service is provided "as is" without warranties or conditions. In exceptional circumstances, interruptions or errors in our service may occur. You waive any claim for special, indirect and consequential damages against us. These Terms do not limit any non-waivable warranty or consumer protection rights you may have under the mandatory laws of your place of residence.

4.Class Action Waiver.

To the extent permitted by applicable law, you and Crush agree to bring a claim against the other party solely on your behalf or Crush's individual behalf and not as plaintiff or member of a class in any proposed class or representative action. Additionally, to the extent permitted by applicable law, unless you and Crush agree otherwise, the court may not consolidate multiple claims with your claim and may not otherwise preside over any form of class or representative action.

5.Other terms

5.1 .

Unsolicited material. Crush does not accept unsolicited material or ideas for use in the content of the film and is not responsible for any similarity between the content or program in any of its media and the material or ideas transmitted to the film.

5.2 .

Changes and transfers of User Terms of Service. Videos may amend these User Terms of Service from time to time. If there are material changes, we will notify you at least one month before such changes occur. If you do not wish to accept the changes, you may cancel your membership before the changes take effect. We may transfer or assign our agreement with you, including related rights and obligations, at any time. You agree to cooperate with us regarding any related transfer or assignment.

5.3.

Electronic communications. We will only send you account-related information (e.g. payment authorizations, billing, password or payment method changes, confirmation messages, notifications) in electronic form, for example by sending an email to the email address you provided when you registered.
